By accessing or using Skhokho Labs services, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

Skhokho Labs provides an AI-powered platform that builds branded Progressive Web Apps (PWAs) for South African businesses within 3 business days. Features include digital menus, appointment booking, inventory tracking, loyalty programmes, sales analytics, and a WhatsApp AI assistant.

You must be a legitimate, lawfully operating business in South Africa. By using our services, you confirm that your business complies with all applicable South African laws and regulations.

• Services are provided on a monthly rolling subscription basis
• Subscription fees are charged monthly in advance
• Payment is processed via Ozow (EFT and card)
• Subscriptions auto-renew monthly unless cancelled
• You may cancel at any time; cancellation takes effect at the end of the current billing period
• No refunds are issued for partially used billing periods, except within 7 days of your first charge if the app has not been delivered

We commit to delivering your configured app within 3 business days of completing the WhatsApp onboarding interview. Delivery times may be extended for complex customisations. We will communicate any delays via WhatsApp.

• Your business data (menu items, products, bookings, customer data) belongs to you
• The Skhokho Labs platform, AI models, and codebase are our intellectual property
• You grant us a limited licence to use your business name and branding solely for the purpose of building and operating your app
• You may not resell, sublicence, or attempt to replicate the platform

You may not use the platform for:

• Illegal goods or services
• Spam or unsolicited messaging
• Misleading or fraudulent business information
• Any activity that violates South African law

We reserve the right to suspend or terminate accounts that violate these terms without refund.

Agents who refer businesses earn commission as detailed on the /agents page. Commission is paid monthly for active, paying referrals. Commission rates are subject to change with 30 days' notice. Agents must not misrepresent the platform or make promises beyond what Skhokho Labs officially offers.

We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated 24 hours in advance via WhatsApp. We are not liable for losses arising from service interruptions.

To the maximum extent permitted by South African law, Skhokho Labs is not liable for:

• Loss of revenue or profits
• Loss of data (beyond reasonable backup restoration)
• Indirect or consequential damages

Our total liability is limited to the fees paid by you in the 3 months preceding the claim.

These terms are governed by the laws of South Africa. Disputes will be subject to the jurisdiction of the South African courts.

We may update these terms with 14 days' notice communicated via WhatsApp or email.
